⏳ DON'T PLAY WITH THE TEXT WITH THE ULAMA'S FATWA REGARDING THE PERMISSIBILITY OF GIRLS' TN DORMITORIES

A question from the brothers: 

May Allah reward the Sheikh.


Recently, defenders of TN always cite the fatwas of senior scholars about the permissibility of the TN dormitory and claim that women residing there no longer need a mahram, which has no basis. They argue that women can stay in the TN dormitory. However, the brothers here are still doubtful about the meaning of the TN dormitory in the scholars' fatwas, and the defenders of TN always argue, “This is their ijtihad as scholars. You have fatwas from scholars, and we also have fatwas from scholars, and you like to cause division.”

Response to this doubt from several perspectives:


**1️⃣ The First Perspective:**


Look, O readers, may Allah bless you.


👉🏼 Pay attention to the clear verses (whose meanings are explicit).


Allah says: 


وَقَرْنَ فِي بُيُوتِكُنَّ وَلَا تَبَرَّجْنَ تَبَرُّجَ ٱلْجَٰهِلِيَّةِ ٱلْأُولَىٰ ۖ


"And stay in your houses and do not display yourselves as in the times of ignorance." (Surah Al-Ahzab, Ayah 33)


🖋️ Sheikh Al-Uthaymeen (may Allah have mercy on him) said: Allah says: 


وَقَرْنَ فِي بُيُوتِكُنَّ 


Meaning: Stay in your houses and remain settled.


This differs from saying in the verse: 


وَٱبْقِينَ فِي بُيُوتِكُنَّ 


"And remain in your houses."


In the subsequent verse, Allah says:


فِي بُيُوتِكُنَّ


"In your houses"


In this verse, there is an attribution (idhafah) of the house to you (كن), which means ownership.


If Allah had said فى البُيُوتِ /fil buyuut without the attribution to كن, it would mean staying in any house, including dormitories, orphanages, private homes, rented houses, hotel rooms, and boarding houses, which means a place of residence.


🖋️ Al-Raghib Al-Asfahani (may Allah have mercy on him) said: 


"The origin of the word 'house' means a place where a person returns at night. It is called a house without considering the time of night."


🚫 So, is it correct that the female TN dormitory, where they reside, is not included in the above verse?


The answer is yes, it is not included in the verse.


🚫 Isn't it that a woman's move from her original home to stay in a female dormitory, as her new place of residence, is not included in the verse above (Surah Al-Ahzab, Ayah 33)?


The answer is yes, it is not included in the verse.


👉🏼 They rely only on the linguistic meaning of the house as a place of residence, without looking and combining what is contained in the Qur'an and hadith with the understanding of the Salaf.


This is the approach of the people of falsehood in establishing their falsehood by relying on linguistic meanings without considering the specificity of the Qur'an and Sunnah.


🖋️ Sheikhah Ummu Hafs Al-Hadramiyyah (may Allah preserve her) said:


As for women, staying in the female dormitory contradicts Shariah and is a sin because women are commanded to stay at home and not to leave except for a need. How can a woman spend the night outside her home? She needs someone to take care of her. How can she be in one place and her guardian in another?


📚 End of the quote.


▪️ A woman who is settled does not need a mahram, which is only needed during travel. But why don't they want to follow the Shariah command for women to stay at home?


وَقَرْنَ فِي بُيُوتِكُنَّ 


"And stay in your houses."


👉🏼 O readers, may Allah bless you:


They have adopted the approach of the people of falsehood, taking some hadith (about the necessity of a mahram for travel) and leaving the other verse (about the command for women to stay at home).


Allah says: 


أَفَتُؤْمِنُونَ بِبَعْضِ ٱلْكِتَٰبِ وَتَكْفُرُونَ بِبَعْضٍ ۚ 


"Do you believe in part of the Scripture and reject the rest? Then what is the recompense of those who do so among you, except disgrace in the life of this world, and on the Day of Resurrection, they will be sent back to the most severe punishment." (Surah Al-Baqarah, Ayah 85)


And also Allah says: 


الَّذِينَ جَعَلُوا الْقُرْآنَ عِضِينَ 


"They are the ones who have made the Qur'an into parts." (Surah Al-Hijr, Ayah 91)


They take some and reject some according to their desires and interests.


And it is narrated by Imam Bukhari and others from Ibn Abbas:


"Those who made the Qur'an into parts: they are the people of the Book, who believed in some parts of it and rejected others."


👉🏼 The state of Ahlus Sunnah and its followers is different, as described by Imam Ibnul Qayyim (may Allah have mercy on him):


"They do not do what the people of whims and innovations do, dividing the Qur'an into parts, believing in some and rejecting others without a clear distinction."


📚 I'lam Al-Muwaqqiin


**2️⃣ The Second Perspective:**


Their argument with ambiguous fatwas about the permissibility of the female TN dormitory without a mahram, among these fatwas:


1. The fatwa of Sheikh Al-Fawzan (may Allah preserve him) regarding the permissibility of TN according to their assumption from the question posed to him:


"Can my father take me to Egypt and leave me there alone to learn Arabic, and I stay in a house with Muslim sisters?"


👆 We say: This is still ambiguous:


It could mean a rented house, a family home with Muslim sisters, or a boarding house for female students.


2. The fatwa of Sheikh Muqbil Al-Wadi (may Allah have mercy on him) about the permissibility of TN according to their assumption when asked:


"Is it permissible for her to stay alone and seek knowledge, knowing that there are places designated for women?"


👆 This could mean a female dormitory or a rented house for women, or a boarding house for female students.


3. The fatwa of Sheikh Al-Uthaymeen (may Allah have mercy on him) about the permissibility of TN according to their assumption from the question posed to him:


"Is it permissible for a woman to study Shariah in one of the girls' institutes far from her city, traveling with her mahram and staying in a student dormitory, then the mahram returns to her city?"


👆 The term "student dormitory" could mean a dormitory for female students or a special residence for them.


👉🏼 Why do they still argue and rely on ambiguous fatwas from scholars?


▪️ Because it suits their desires and they leave the clear verses.


▪️ To confuse people into thinking the TN dormitory is permissible without a mahram.


👉🏼 This is the approach of the people of whims, who love to argue with ambiguous texts from Allah, His Messenger, and scholars' fatwas, leaving the clear verses, even though both clear and ambiguous texts are in front of them.


Bid'ah blinds their insight and covers their hearts. Allah's statement about them is true:


هُوَ ٱلَّذِىٓ أَنزَلَ عَلَيْكَ ٱلْكِتَٰبَ مِنْهُ ءَايَٰتٌ مُّحْكَمَٰتٌ هُنَّ أُمُّ ٱلْكِتَٰبِ وَأُخَرُ مُتَشَٰبِهَٰتٌ ۖ 


"It is He who has sent down to you the Book; in it are verses that are precise—they are the foundation of the Book—and others unspecific. As for those in whose hearts is deviation, they will follow that of it which is unspecific." (Surah Al-Imran, Ayah 7)


They love to argue with ambiguous texts, which can have different meanings unless combined with clear verses. This is the state of those with sick hearts due to their evil intentions and bad understanding, to mislead people and interpret texts to fit their false sect.


O readers, may Allah bless you.


The muhkam verse, which is already clear in its indication and contains no ambiguity (Allah's command for women to stay and remain in their homes), yet why do they still take the mutasyabih (ambiguous/with multiple meanings) from scholars' fatwas?


▪️ليمكنهم ان يحرفوه الى مقاصدهم الفاسدة وينزلوه عليها


So that they can manipulate the fatwa to suit their corrupt intentions and apply it to their aims,


▪️لإحتمال لفظه لما يصرفونه


Because there is a possibility that its wording can be twisted by them.


👉🏼 And why do they not use the verse that is already muhkam (clear, namely "And stay in your houses") as evidence?


لأن المحكم فلا نصيب لهم فيه


"Because they know that the verse that is muhkam offers them no way to divert it.


لأنه دامغ لهم وحجة وعليهم


Because the muhkam verse defeats them and serves as proof against them.


▪️ابتغاء الفتنة أي الإضلال لأتباعهم إيهاما أنهم يحتجون على بدعتهم بالفتوى من عالم العلماء


Because they seek fitnah, intending to mislead their followers, giving the impression that they base their innovations on scholars' fatwas (not the Qur'an and hadith).


The people of desires do not want to follow the path of Ahlus Sunnah in building their religion on clear verses, and they do not refer the ambiguous fatwas of scholars back to the clear verses. Instead, they cling to what suits their desires.


وهذه الشاكلة أهل البدع فى كل زمان ومكان مهما كان نوع بدعتهم.


This is the pattern of people of innovation in every place and time, no matter the type of innovation.


O readers, may Allah protect you!


Do not underestimate any innovation, and do not consider any innovation insignificant, because this is the path they desire fitnah with, such as the female dormitory, causing people to be misled by bringing ambiguous texts to strengthen their TN innovation. And you see how the Prophet explained their state and warned against them:


إذا رأيتم الذين يتبعون ما تشابه منه، فأولئك الذين سمى الله فاحذروهم 


"When you see those who follow what is ambiguous in it, they are the ones Allah has named; so beware of them." [Muttafaqun ‘Alaihi].


Beware of the ways of the people of falsehood by:


فيجعلون ما ابتدعوه هم برايهم هو المحكم الذي يجب اتباعه وإن لم يكن معهم من الأنبياء، والكتاب والسنة ما يوافقه.


They make what they have innovated with their opinions the muhkam (clear) that must be followed, even though they have no support from the prophets, the book, or the Sunnah to support it."


📚 Majmu fatawa 3/166.


This includes the matter of the female dormitory, which is only supported by:


▪️ Al-Aq'yisah Al-fasidah (corrupt analogies).


▪️ Al-Ah'wa Al-Mudhillah (misleading desires).


▪️ Al-Araa' Al-Madz'mumah (reprehensible opinions).


And the founders and defenders of TN will always:


يبحثون عن الشيء من الشبهة الذي يتفق مع اهوائهم ومع مناهجهم، ومقاصدهم، ومذاهبهم بإنشاء معهد تربية النساء بغض النظر عن مراد الله ورسوله، ولو كانوا يريدون مرادهما لكان الأمر واضحا جليا لا غبار عليه


Seek something of doubt that aligns with their desires, methodology, goals, and schools of thought in establishing the female dormitory, disregarding what Allah and His Messenger desire. If they wanted what Allah and His Messenger wanted, the matter of the female dormitory would be clear, evident, and without any doubt.
