**The Ruling on Raising the Flag During Independence Day Celebrations**
**Question from a WhatsApp group, Nashihatulinnisa:**

السلام عليكم ورحمة الله ورحمة الله.
May Allah bless you, our Shaykh.
What is the ruling on raising the national flag for the occasion of Independence Day, considering that the village head encourages and urges the community to do so? We fear that if we don't, we may be accused of being from the Khawarij (rebels) and disobedient to the ruler. What is your advice, O our Shaykh?
**Answer from Shaykh Tariq Al-Ba'dany (may Allah protect him):**
وعليكم السلام ورحمة الله وبركاته.
Obedience is only in what is good. It is advised not to do this because this act (raising the flag) involves glorifying the national flag, and it is not permissible. We are not from the Khawarij, and this act (not raising the flag) is not considered rebellion, neither in custom, nor in Shariah, nor in reason. The people of Ahlus-Sunnah wal Jamaah are among the most obedient to their rulers, and reality bears witness to this throughout the years.
**Answer from Shaykh Abdul Ghani Al-Umary (may Allah protect him):**
This is not permissible; it is imitation of the disbelievers. We ask Allah for safety. This is imitation of the enemies of Islam. These flags and the act of lowering them (as a sign of respect) have no connection with it (Islam), and sometimes they glorify the flag to a greater extent than some Islamic symbols.

**Answer from Shaykh Al-Allamah Al-Muhaddith Salim Ied Al-Hilaly (may Allah protect him) when asked:**
What is the ruling on raising the national flag for the occasion of Independence Day?
His answer:
The origin is that these are non-Shariah-sanctioned occasions, so it is not appropriate to participate in them. However, if not doing so results in harm to a person’s wealth, honor, or life, then if one does it to avoid harm, and similarly, if it prevents the Khawarij and Hizbiyyun (party affiliates) from rebelling against the state or the ruler, then there is no sin in doing so. And Allah knows best.

Qu'Allah vous bénisse, notre Cheikh.
Quel est le jugement sur le fait de hisser le drapeau national à l'occasion de la Journée de l'Indépendance, sachant que le chef du village encourage et incite la communauté à le faire ? Nous craignons que si nous ne le faisons pas, on nous accuse d'être des Khawarij (rebelles) et désobéissants au gouverneur. Quel est votre conseil, ô notre Cheikh ?
**Réponse de Shaykh Tariq Al-Ba'dany (qu'Allah le protège) :**
وعليكم السلام ورحمة الله وبركاته.
L'obéissance ne doit se faire que dans ce qui est bien. Il est conseillé de ne pas le faire car cet acte (lever le drapeau) implique de glorifier le drapeau national, et cela n'est pas permis. Nous ne sommes pas des Khawarij, et cet acte (ne pas hisser le drapeau) n'est pas considéré comme une rébellion, ni selon la coutume, ni selon la Charia, ni selon la raison. Les gens de Ahlus-Sunnah wal Jamaah sont parmi les plus obéissants envers leurs gouverneurs, et la réalité en témoigne au fil des années.
**Réponse de Shaykh Abdul Ghani Al-Umary (qu'Allah le protège) :**
Cela n'est pas permis ; c'est une imitation des mécréants. Nous demandons à Allah la sécurité. C'est une imitation des ennemis de l'Islam. Ces drapeaux et l'acte de les abaisser (en signe de respect) n'ont aucun lien avec cela (l'Islam), et parfois ils glorifient le drapeau à un degré plus élevé que certains symboles islamiques.

Quel est le jugement sur le fait de hisser le drapeau national à l'occasion de la Journée de l'Indépendance ?
Sa réponse :
L'origine est que ce sont des occasions non sanctionnées par la Charia, donc il n'est pas approprié d'y participer. Cependant, si ne pas le faire entraîne un préjudice pour les biens, l'honneur ou la vie d'une personne, alors si on le fait pour éviter ce préjudice, et de même, si cela empêche les Khawarij et Hizbiyyun (affiliés à des partis) de se rebeller contre l'État ou le gouverneur, alors il n'y a pas de péché à le faire. Et Allah sait mieux.

अल्लाह आपको आशीर्वाद दें, हमारे शेख।
स्वतंत्रता दिवस के अवसर पर राष्ट्रीय ध्वज फहराने का हुक्म क्या है, यह ध्यान में रखते हुए कि गाँव का मुखिया समुदाय को ऐसा करने के लिए प्रोत्साहित और आग्रह कर रहा है? हमें डर है कि अगर हम ऐसा नहीं करते हैं, तो हमें खवारिज (विद्रोही) और हुक्मरान के प्रति अवज्ञाकारी होने का आरोप लगाया जाएगा। आपका क्या परामर्श है, ओ हमारे शेख?
**शेख तारिक अल-बादनी (अल्लाह उन्हें सुरक्षित रखे) का जवाब:**
وعليكم السلام ورحمة الله وبركاته
आज्ञा केवल अच्छे कार्यों में दी जानी चाहिए। इस बात की सलाह दी जाती है कि ऐसा न किया जाए, क्योंकि यह कार्य (ध्वज फहराना) राष्ट्रीय ध्वज की महिमा में वृद्धि करता है, और यह अनुमति नहीं है। हम खवारिज (विद्रोही) नहीं हैं, और यह कार्य (ध्वज न फहराना) न तो प्रचलन में, न ही शरीयत में, और न ही समझ में विद्रोह के रूप में गिना जाता है। अहलुस-सुन्नह वल जमाअह के लोग अपने शासकों के प्रति सबसे अधिक आज्ञाकारी होते हैं, और वर्षों से वास्तविकता इसका प्रमाण देती है।
**शेख अब्दुल गनी अल-उमरी (अल्लाह उन्हें सुरक्षित रखे) का जवाब:**
यह अनुमति नहीं है; यह काफिरों की नकल है। हम अल्लाह से सलामती की दुआ करते हैं। यह इस्लाम के दुश्मनों की नकल है। ये सारे ध्वज और उनके प्रति सम्मान का झुकाव इसका कोई संबंध नहीं है, बल्कि कभी-कभी वे ध्वज को इस्लाम के कुछ प्रतीकों से भी अधिक महत्त्व देते हैं।

**शेख अल-आल्लामा अल-मुहद्दिस सलीम ईद अल-हिलाली (अल्लाह उन्हें सुरक्षित रखे) का उत्तर जब उनसे पूछा गया:**
स्वतंत्रता दिवस के अवसर पर राष्ट्रीय ध्वज फहराने का हुक्म क्या है?
उनका उत्तर:
मूलतः ये गैर-शरीयत मान्यता प्राप्त अवसर हैं, इसलिए इसमें भाग लेना उचित नहीं है। हालाँकि, यदि ऐसा न करने से किसी के धन, सम्मान या जीवन को हानि पहुँचती है, तो यदि वह इसे उस हानि से बचाने के लिए करता है, और इसी तरह यदि यह खवारिज और हिज्बियों (दल के लोगों) को राज्य या शासक के खिलाफ विद्रोह करने से रोकता है, तो इसे करने में कोई पाप नहीं है। और अल्लाह बेहतर जानता है।
